Commercial Law and Litigation

SVG represents local, regional and national clients in a wide variety of litigation matters in state and federal courts. We have successfully represented businesses and individuals in suits involving commercial, environmental, contract, professional malpractice, securities, fiduciary, licensing, product liability, defamation, employment and lender liability disputes. We also have substantial experience in appellate matters, routinely representing clients before the Delaware Supreme Court and the federal appellate courts.

Corporate Law and Litigation

Delaware has long been recognized as the leading jurisdiction for corporate law. We have successfully handled Court of Chancery litigation involving all aspects of Delaware corporate law, including breach of fiduciary duties, mergers and acquisitions, asset and stock purchases, appraisal proceedings, dissolution and liquidations, special litigation committees, and indemnification and advancement of litigation expenses. Our experience in corporate matters has led law firms throughout the country to partner with SVG to represent clients in the renowned Court of Chancery.

Construction Law and Litigation

SVG represents a broad range of clients involved in construction disputes, including general contractors, subcontractors, architects, and engineers. SVG has vast experience in complex construction litigation and mechanics lien actions. We have obtained substantial awards for our clients in state and federal court.

Intellectual Property Litigation

SVG represents clients in complex disputes involving patents, trade secrets, copyrights, unfair competition and antitrust issues in both federal and state court. We have successfully litigated cases involving products and services in many varied industries and technology-related fields.

Bankruptcy Law and Litigation

SVG represents the full range of secured and unsecured creditors in large and complex Chapter 11 reorganizations and Chapter 7 proceedings, including equity holders, trade creditors, equipment lessors, reclamation claimants, utility providers, landlords and tort claimants.  We also have considerable experience representing those entities sued by Debtors in actions to recover preferential payments.

Employment Law and Litigation

SVG’s practice in the area of employment law includes representation of both employers and employees. We have litigated cases involving claims of discrimination under federal statutes, as well as state court cases involving covenants not to compete, trade secrets and claims based upon violations of employment contracts. We also provide advice, with an eye toward avoiding litigation, to employers and employees on a wide range of employment issues, including employment, non-compete and separation agreements.

Foreign Judgments Enforcement

Many corporations operating throughout the world are incorporated in Delaware. This State, therefore, provides an ideal jurisdiction for judgment creditors to enforce foreign judgments. Although a few years ago the law of foreign judgment enforcement was not well developed in Delaware, an SVG partner, George H. Seitz, III, prosecuted an enforcement case from 2005 to 2010 making major inroads in the development of the law of foreign judgment enforcement. In the case of In Re: Transamerica, SVG sought and obtained an enforcement of a Nigerian judgment under the Delaware Uniform Enforcement of Foreign Money Judgment Recognition Act in the Delaware Court of Chancery and ultimately by affirmance in the Delaware Supreme Court. In doing so, SVG developed substantial case law in the area of foreign judgment enforcement, including on issues of due process, notice of foreign proceedings, jurisdictional requirements, governing statutes of limitations, principles of laches, calculation of interest and interpretation of foreign judgments. SVG will welcome the opportunity to assist judgment creditors in the enforcement of judgments in Delaware whether issued from a foreign jurisdiction or a U.S. court.
